Background Institutional Review Boards (IRBs) are federally mandated to include both nonscientific and unaffiliated representatives in their membership. Despite this, there is no guidance or policy on the selection of unaffiliated or non-scientist members and reports indicate a lack of clarity regarding members’ roles. In the present study we sought to explore processes of recruitment, training, and the perceived roles for unaffiliated and non-scientist members of IRBs.Methods We distributed a self-administered REDCap survey of members of the Association for the Accreditation (...) of Human Research Protection Programs familiar with IRB member recruitment. The survey included closed and open-ended questions regarding: the operation of the HRPP/IRB(s), how unaffiliated and non-scientist members are recruited, whether they had faced challenges recruiting for these roles, and training and mentorship offered. The survey also collected information regarding the perceived value and roles of unaffiliated and non-scientist members.Results 76 responses were included in the analysis (38% completion rate). The most common approach for recruitment was referral from current IRB members, with almost half of respondents indicating challenges recruiting unaffiliated members. Over 75% indicated no additional training was provided to unaffiliated or non-scientist members compared to affiliated or scientist members. Most common supports provided were travel/parking expenses and honoraria. Commonly perceived roles were to provide an independent voice from the participant perspective, notably regarding consent processes and materials.Conclusions Respondents indicated challenges in defining unaffiliated and non-scientist members and limited practices toward recruitment and support. Future work should more closely examine the challenges in defining these roles and applying the definitions in practice, as well as strategies that may improve recruitment and retention of unaffiliated and non-scientist members. Participants in clinical research sometimes view participation as therapy or exaggerate potential benefits, especially in phase I or phase II trials. We conducted this study to discover what methods might improve cancer patients’ understanding of early-phase clinical trials. We randomly assigned 130 cancer patients from three U.S. medical centers who were considering enrollment in a phase I or phase II cancer trial to receive either a multimedia intervention or a National Cancer Institute pamphlet explaining the trial and its purpose. Intervention (...) participants were 32 times more likely to believe that the trial’s purpose was to examine safety and 60 % less likely to believe they would experience long-term benefit or cure. There was no difference in enrollment decision. However, while patients’ understanding of the trial’s purpose improved and expectations of long-term benefit diminished, half the respondents still believed they would experience long-term benefit or cure from participation. Therefore, we conclude that multimedia interventions such as this one may help oncologists to explain the risks and benefits of early-phase cancer trials in a way that patients can more easily understand, helping them to make more informed decisions about participation. But further research into other factors that influence patients’ beliefs about the outcome of enrollment is needed, both to modify the interventions and to determine how malleable patient beliefs are. Is it possible to say anything on the well-worn theme of human freedom or unfreedom which has not been ahready better said by someone else before us? It may be doubted; yet it is always worth while to see whether we cannot at least set what is perhaps already familiar to us in a fresh light and so come to a clearer comprehension of our own meaning. This, at any rate, is all that will be attempted in these pages; I (...) have spoken in an earlier essay of the “practical situation” in which we find ourselves whenever we have to make a decision as involving indetermination , and my purpose is simply to make it plainer to myself, and so incidentally perhaps to a reader, what I mean by such an expression. I shall start, then, by adopting what we may perhaps agree to call a phenomenological attitude to the subject; that is, I will try to describe the facts in a way which anyone who recalls occasions when he has been driven to take a decision will recognize as faithful to his experience, without imparting into the description any element of explanatory speculative hypothesis. The description is meant to be one which will be admitted to be true to the “appearances,” independently of any theory about the “freedom of the will”—to describe correctly that which it is the object of all such theories to explain. Derek Taylor Mary Astell (1666-1731), most famous today for her call for the establishment of Protestant nunneries in Serious Proposal to the Ladies, Part I (1694) and for her acute Reflections Upon Marriage (1700), has lurked for years at the edges of that (...) infinitely contentious category "feminism," but she is only now beginning to receive her rightful inheritance as a theological and philosophical thinker, probably the title she would most have preferred. 1 This is not to say that Astell's Christian-Platonism has been ignored. In her 1986 biography Ruth Perry gave cogent expression to the centrality of Astell's idealist Christianity to all aspects of her thought 2 and in the same year, Bridget Hill thoughtfully warned her readers against attempting to force Astell, a religious conservative, "into some preconceived idea of what late seventeenth and early eighteenth century feminism ought to have been." 3 More recently, Patricia Springborg has written two significant essays that rely in part on Astell's more neglected theological-philosophical works, Letters concerning the Love of God (1695), a collection of Astell's correspondence with John Norris of Bemerton (1657-1711), and The Christian Religion, As Professed by a Daughter of the Church of England (1705; 3d edition 1730), far and away her most developed theological-philosophical [End Page 505] statement. 4 Despite these important forays, however, both Letters and Christian Religion continue to be largely ignored, as is suggested by the relative dearth of scholarly work on either text and the short shrift each receives in anthologies of Astell's works. 5 Despite the great popularity of Letters throughout the eighteenth century and despite the fact that, as Springborg points out, Astell considered Christian Religion "her magnum opus," neither text has found new life in a modern edition. 6This omission creates a rather vexing problem for would-be scholars of Astell's philosophical and theological ideas. The major primary texts themselves not being available, we have little choice but to rely on the limited accounts of other scholars for our information. Over a decade ago, for instance, The Journal of the History of Philosophy published a long note by Kathleen M. Squadrito on "Mary Astell's Critique of John Locke's View of Thinking Matter," and hers has since been the standard (if not quite only) account of this historically fascinating and important philosophical comment in Christian Religion.7 Squadrito wants, she writes, to "present a short account of [Astell's] work and her criticism of Locke's view of thinking matter." 8 Unfortunately, Squadrito's account of Astell's "work" is significantly flawed, which leads her to serious mischaracterizations of Astell's "criticism" of Locke's hypothesis. Briefly put, Astell's "own philosophy" in Christian Religion does not, as Squadrito claims, emerge "as an attempted reconciliation of the views of Norris and Locke" 9 ; because she supposes it does, however, Squadrito is able to present Astell's critique of Locke's theory [End Page 506] of thinking matter as a respectful, even-handed philosophical analysis, a theoretical bridge, as it were, between the Platonism of Norris and the Empiricism of Locke. As we shall see, Astell's critique of Locke's hypothesis actually amounts to a bitterly ironic assault, wherein Astell does not so much build bridges as burn them. Just why Astell in Christian Religion decided not to strike a middling position between Locke and Norris, and how this decision invigorated her attack on Locke's materialist hypothesis, are the primary questions this essay seeks to answer. A standard approach to indeterminacy treats ‘determinately’ and ‘indeterminately’ as modal operators. Determinacy behaves like necessity; indeterminacy like contingency. This raises two questions. What is the appropriate modal system for these operators? And how should we interpret that system? Ken Akiba has developed an account of ontic indeterminacy that interprets possible worlds as worldly precisifications. He argues that this account vindicates S4 as the logic of indeterminacy. In this paper I explore one significant and surprising consequence of this view. I (...) do this in two stages. First, I prove a technical result, which I call the Infinite Indeterminacy Theorem. Roughly put, this theorem states that, at any given precisification w, either every instance of indeterminacy admits of never-ending higher-order indeterminacy, or else there's indeterminacy in an infinite amount of distinct atomic formulas. In slogan form: either all indeterminacy is infinitely ascending or else there's infinitely wide indeterminacy. Second, I unpack the metaphysical consequences of this technical result (under its intended interpretation) and assess their plausibility. I conclude that these consequences commit Akiba's theory to highly contentious – and arguably untenable – views about the metaphysics of indeterminacy and related matters. (shrink)

The main thesis of this paper is that it is not possible to determine the nature of epistemic justification apart from scientific psychological investigation. I call this view the strong thesis of methodological psychologism. Two sub-theses provide the primary support for this claim. The first sub-thesis is that no account of epistemic justification is correct which requires for the possession of at least one justified belief a psychological capacity which humans do not have. That is, the correct account of epistemic (...) justification must be psychologically realistic. The second sub-thesis is that it is not possible to determine whether an account of epistemic justification is psychologically realistic apart from scientific psychological investigation. After defending these subtheses, I point out some interesting consequences of the overall thesis which present a challenge to traditional epistemology. (shrink)

Neo-Fregeanism is a family of positions in the philosophy of mathematics that combines a certain type of platonism about mathematical abstracta with a certain type of logicism about the foundations and epistemology of mathematics. This paper addresses the following question: what sort of theory of reference can/should NF be committed to? The theory of reference I propose for NF comes in two parts. First, an alethic account of referential success: the fact that a term ‘a’ succeeds in referring to something (...) depends on facts about truth. Second, a deflationary account of referential specification: given that ‘a’ refers to something, the fact that ‘a’ refers to b specifically follows from the disquotational schema for reference together with the fact that b = a. In the first section of the paper I argue that NF should be committed to the first part of this theory. This a point on which there is already agreement. The bulk of the paper is therefore devoted to arguing that NF should be committed to the second part, given that it is committed to the first part. I close the paper by indicating some significant implications and a possible problem for this theory of reference. (shrink)

It is a point of some interest to the historian of the social and intellectual development of Athens to determine, if possible, the exact dates between which the philosopher Anaxagoras made that city his home. As everyone knows, the tradition of the third and later centuries was not uniform. The dates from which the Alexandrian chronologists had to arrive at their results may be conveniently summed up under three headings, date of Anaxagoras' arrival at Athens, date of his prosecution and (...) escape to Lampsacus, length of his residence at Athens, The received account , was that Anaxagoras was twenty years old at the date of the invasion of Xerxes and lived to be seventy-two. This was apparently why Apollodorus placed his birth in Olympiad 70 and his death in Ol. 88. I, thus giving the years 500–428 B.C. of our reckoning, The further statement of Apollodorus that Anaxagoras xs1F24ρξατο xs03D5ιλοσοxs03D5εxs1FD6ν xs22EFπxs22EF Καλλίον has given rise to discussion; but when we remember that Demetrius of Phalerum had made what ‘Diogenes’ regards as an equivalent statement in his register of archons, and had said that Anaxagoras was twenty years old at the time, I think there can be no doubt of the meaning. Demetrius had clearly mentioned something about Anaxagoras which was looked on as giving the date at which he ‘began to philosophize,’ and had given his age at the time. The natural interpretation is that Demetrius mentioned the year of Anaxagoras’ arrival at Athens, and that this was taken as the time at which he ρξαtο φιλοσοφεlσ And it is further reasonable to suppose that this date was the source of the further statement of Demetrius, that Anaxagoras was born in or about 500 B.C. We may, I think, infer that Demetrius recorded the arrival of Anaxagoras in Athens under the year 480, giving his approximate age at that time. (shrink)

Our first observation is: Theorem. Turning our attention to large cardinals, we extend the usual (weak) Mahlo hierarchy to define "greatly Mahlo" cardinals and obtain the following: Theorem. If κ is greatly Mahlo then NS is not κ + -saturated. Theorem. If κ is ordinal Π 1 1 -indescribable (e.g., weakly compact), ethereal (e.g., subtle), or carries a κ-saturated ideal, then κ is greatly Mahlo. Moreover, there is a stationary set of greatly Mahlo cardinals below any ordinal Π 1 1 -indescribable cardinal. Suppose that a school restricts student expression critical of homosexual conduct yet allows or actively supports student expression that promotes acceptance and tolerance of gays and lesbians. Can such a policy be justified if the anti-gay speech disrupts the educational environment of the school while the pro-gay speech does not? Or does the differential treatment of anti-gay and pro-gay speech constitute unconstitutional viewpoint discrimination because it distorts the marketplace of ideas within the school? Can viewpoint discrimination ever be justified on (...) the ground that anti-gay speech invades the rights of others under Tinker v. Des Moines Independent Community School District, 393 U.S. 503 (1969)? These were among the questions debated by Judges Reinhardt and Kozinski in the Ninth Circuit's now-vacated panel opinion in Harper v. Poway Unified School District, 445 F.3d 1166 (9th Cir. 2006), but their significance to the law of student speech is quite general. Courts are increasingly becoming concerned with the question of whether Tinker allows viewpoint-based restrictions of student speech, but so far jurists have not reached agreement on this question or even on the simpler question of what counts as viewpoint discrimination. This article attempts to clarify the emerging debate about the permissibility of viewpoint discrimination under Tinker and proposes modifications to the Tinker framework that would enable courts to deal more fruitfully with charges that school officials have imposed viewpoint-based restrictions on student speech. I argue that we should think of viewpoint discrimination as purposeful restriction of expression on the basis of governmental disagreement with the message. Tinker must be understood to bar purposeful viewpoint discrimination, but the conclusion that a school speech restriction constitutes purposeful viewpoint discrimination will come at the end rather than at the beginning of constitutional analysis. A school will never announce that it has restricted student speech on the basis of disagreement with the message; instead, it will claim that it has regulated speech to prevent harm. And this is something that schools (and the state more generally) may sometimes do - at least with sufficient justification. Tinker obviously contemplates the regulation of speech where necessary to prevent two specific sorts of harms - disruption to the school's mission and violations of the rights of other students - and so must require courts to distinguish between school speech restrictions based on impermissible ideological purposes and those based on the permissible purposes of preventing disruptions or violations of student rights. Tinker's substantial disruption test, I contend, should primarily be understood as a mechanism for helping courts to smoke out these impermissible purposes. (shrink)

I must explain at once that these few pages do not attempt or pretend to be anything like a formal review of the recently published posthumous volume of Professor Bowman with the same title. I am precluded from writing such a review partly by the wide range of problems attacked by the author, partly by my own insufficient familiarity with many of the positions of the most recent physical and natural science which are brought under review. I will therefore confine (...) myself, so far as the strict business of the reviewer is concerned, to the single remark that the editor, Professor J. W. Scott, has discharged his difficult task of preparing the book for publication—no easy matter, as will be seen from his Preface—with equal skill and devotion, and has laid himself open to no worse criticism than that there are less than a dozen obvious slight misprints which have escaped detection, but will readily be detected by a careful reader. What I propose to do in the remarks which follow is simply to indicate the very real importance of the book by saying something as to its main purpose and thesis, and the points where I still feel that there is some difficulty or ambiguity about the writer's position which would, no doubt, have been largely cleared up if he had lived to reconstruct the whole six of his Vanuxem Lectures for publication as he has done the first three. The current literature on indeterminacy centers around two projects. One concerns the logic of indeterminacy; the other concerns its nature or source. The aim of this paper is to introduce, motivate and go some way toward addressing a new, third project: that of providing what I call a minimal characterization of indeterminacy. An MC, to a first approximation, is a relatively pre-theoretical characterization of indeterminacy that is neutral between the various substantive theories of the nature and logic of indeterminacy. An (...) MC thus captures a generic sense of indeterminacy that, at least in principle, is recognized by all parties to the debate over the phenomenon’s underlying nature and logic. I begin by introducing the concept of an MC and outlining some of the main theoretical virtues of providing an MC. I then establish some desiderata on a suitable MC, and use these desiderata to rule out various initially attractive proposals. In the final part of the paper I sketch the beginnings of my own MC and defend it against objections. (shrink)

This paper consists of two parts. In the first, we discuss the neuropsychological correlates of belief in a 'paranormal' or magical causation of coincidences. In particular, we review experimental evidence demonstrating that believers in ESP and kindred forms of paranormal phenomena differ from disbelievers with respect to indices of sequential response production and semantic-associative processing. Not only do believers judge artificial coincidences as more 'meaningful' than disbelievers, they also more strongly suppress coincidental productions (i.e. repetitions) in their generation of random (...) sequences. These findings illuminate the cognitive mechanisms underlying the formation and maintenance of paranormal beliefs for which the right cerebral hemisphere is hypothesized to play a central role. These same right hemispheric semantic-associative processing characteristics are centrally implicated in the creative thought process as well as the genesis of delusional (pathological) beliefs (e.g. ideas of reference). One of the most popular and enduring approaches to indeterminacy phenomena (e.g., vagueness) over the past several decades has been some form or another of supervaluationism. I argue that supervaluationism is inadequate as a model of indeterminacy: There is an entire class of examples of indeterminacy, characterized by a common “branching” structure, that cannot be modeled in the way supervaluationism proposes. I demonstrate my conclusion explicitly with respect to two specific examples—indeterminate personal identity and indeterminate reference—showing how supervaluationism can model (...) neither. Importantly, my arguments apply to both traditional “semantic” and more recent “metaphysical” versions of supervaluationism. (shrink)

According to Sextus Empiricus, (i) the principal aim of Pyrrhonian skepticism is to achieve tranquility, and (ii) the skeptic is uniquely positioned to realize this aim. I challenge (ii) by arguing that the value nihilist—who believes that nothing is good or bad—can achieve the exact same tranquility as the skeptic. From this comparison I draw important conclusions about the relations among skepticism, tranquility and the value of knowledge.

The idea of there being “no fact of the matter” (NFM) features centrally in Quine’s indeterminacy theses. Yet there has been little discussion of how exactly Quine understands this idea. In this paper I identify, develop and then critically evaluate Quine’s conception of NFM. In Sects. 3–4 I consider a handful of intuitive semantic and ontological conceptions of NFM and argue that none is workable from within Quine’s philosophy. I conclude that the failure of each of these proposals is due (...) to the immanent status of truth and existence for Quine. In Sect. 5 I then present Quine’s official conception of NFM. Briefly, Quine’s idea is that there is NFM between two theories of translation iff those theories are physically equivalent. I develop this idea in detail. Finally, I raise two independent problems for this conception of NFM. In Sect. 6 I argue that Quine’s definition is too strong: given what he means by NFM, his arguments for indeterminacy—even granting all their premises and internal reasoning—simply cannot support his claim that there is NFM regarding translation; instead they establish a strictly weaker conclusion. In Sect. 7 I argue that Quine’s conception of NFM is in significant tension with his thesis of physicalism, and that he must give up one or the other. (shrink)

The dissertation is an interdisciplinary study of the dismantling effects postmodern discourses have within the humanities. Postmodernism's anti-foundationalism, I argue, can only take shape around questions of ultimacy and sacrality in human existence. The dissertation explores the emergence, persistence and metamorphosis of the ultimate and the sacred in art history, modern literature, continental philosophy, and religion. Central figures studied in the work include Mircea Eliade, Gilles Deleuze, Jacques Derrida, Andre Malraux, Friedrich Nietzsche, and Ludwig Wittgenstein.
